The Automobile Accident

Nobody wants or expects to be in an automobile accident. However, being prepared is always a good idea. I suggest that you keep the following in your car at all times:

  • A pad and working pen.
  • A disposable camera.

If you are involved in an automobile accident (as either a driver or a passenger) remember to:

  • Get names and contact information of the other vehicle
  • Get the names of any and all witnesses.
  • Take Photographs of the scene and the vehicle damage
  • Don’t be a hero… if you need medical attention don’t be embarrassed to ask for it.
  • Tell the police officer what happened and get his badge number and precinct.

As soon as you are able, you need to:

  • Notify Your Insurance Company ASAP.
  • Get a copy of the police accident report (usually available a few days after the accident from the local police precinct).
  • Keep all of the documents (including any damage estimates) organized and in one readily accessible place.

If you are hurt, it is vitally important to seek prompt medical attention and to follow your doctors’ recommendations. In New York State, insurance called “No-Fault” insurance is typically available to pay for your medical care and lost wages. In tending to your injuries be aware of the following:

  • You may have suffered injuries which are initially masked by other problems in the period following the accident. Be sure to give your treating doctors a full and complete history of your complaints at each and every visit.
  • Keep a file and document your injuries/complaints and your medical care.
  • Keep all bills and receipts (especially if not covered by insurance).

In most cases, it is a good idea to contact an attorney as soon as possible after an accident. It is always a good idea to:

  • Get information
  • Understand your rights
  • Protect yourself

Some facts to keep in mind:

  • A lawsuit must be commenced within three (3) years of the accident.
  • Witnesses may “disappear” and need to be contacted as soon as possible.
  • It is better to begin the process when the memories are fresh.
